2. This web site is owned and operated by localjobsgroup and is made available to advertisers and job seekers on the following terms and conditions. By using the site and the services available advertisers and job seekers are deemed to accept these terms and conditions and any additional terms and conditions which expressly apply to services and information provided by third parties.

3. Data protection Policy
localjobsgroup use of CVs and other personal information supplied by registered users of this site is governed by our Privacy Policy.

General Services and conditions of Web site
The information and services available on the localjobsgroup web sites are provided for the purpose of assisting those looking for job vacancies and career information and for employers and employment agencies seeking to recruit staff. You may use, print and download information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, "screen scrape" display, transmit or distribute any material from the site.
All copyright, database rights and other intellectual property rights in the site and the material available on the site belongs to localjobsgroup or its third party suppliers. Use of the site does not give you any proprietary rights in such materials.

Localjobsgroup products - Job advertisements and CVs
CVs and job advertisements contained on the site are provided by candidates and by prospective employers and their agents and are not reviewed by us. We accept no responsibility or liability for the contents of CVs or advertisements and expect candidates and prospective employers to carry out such verification procedures as are customary and prudent in the circumstances.

Information and services
Services and information appearing on the site and posted by us and our third party suppliers are provided to assist in the job seeking or recruitment process. Neither localjobsgroup nor our third party suppliers can guarantee their suitability or prospects of success in any particular case. You should obtain independent verification before relying on information provided on the localjobsgroup site in circumstances which may result in loss or damage.

Availability of Web site
We try to ensure continuous availability of the site and all the services available on it but accept no responsibility for the consequences of interruptions or delays, however caused. We may at any time, alter the design functionality and specification of the site.

Limitation of liability

LIABILITY

1. localjobsgroup will not be liable (whether in contract or tort) for:

a) Any loss of copy, artwork, photographs, data or other materials that the Client supplies to localjobsgroup and the Client shall be responsible for retaining in its possession sufficient quality and quantity of such materials for whatsoever purposes it may require;

b) Any mistakes or errors whatsoever that arise during the course of publication of any Advertisement or any loss of information or data or any damage thereto in each case as a result of circumstances beyond its reasonable control or which arise as a result of the acts or omissions of the Client;

c) For any loss of profit, loss of revenue or contracts or any indirect, special, economic or consequential loss (whether caused by the negligence of localjobsgroup its employees or agents);

d) Any delay, costs, expense, loss (including loss of profit), damage or liability (including without limitation as a result of any hardware failure, provision or use of software, virus, deletion, corruption, loss or removal of data) howsoever caused arising from any matter beyond the reasonable control of localjobsgroup or as a result of the acts or omissions of the Client;

e) Any loss or damage whatsoever (including loss of profits) howsoever caused arising out of the negligence, dishonesty, misconduct, breach of faith, incompetence, lack of, suitability of or the wrongful disclosure of confidential information by, any Candidate or Applicant. It is for Client to satisfy itself as to the availability, suitability, standard of skill, integrity and reliability of all Candidates or Applicants for any particular job.

2. In no event shall localjobsgroup liability to the Client under or in relation to the Contract (whether in contract or tort) exceed the amount of the Fees.

3. Nothing in this Contract will restrict or exclude localjobsgroup for death or personal injury caused by its own negligence. The Client agrees and acknowledges that save as expressly provided in the Contract no condition, warranty or representation of any kind is, has been, or will be, given by or on behalf of localjobsgroup in respect of or in connection with the Services or the Contract and accordingly the Client confirms that it has not, in entering into the Contract, relied on any condition, warranty or representation by localjobsgroup or any person on its behalf, express or implied, whether arising by law or otherwise in relation to or in connection with the Services or the Contract. The benefit of any such condition, warranty or representation by localjobsgroup is hereby irrevocably and unconditionally waived by the Client.

Credit card payments
Recruitment advertising services require payment to access. The payments are made by monthly invoice or credit card using Barclaycard transaction environment.

Refunds

Governing law
These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts.

Browser and operating system policy
localjobsgroup endeavours to support as many users as possible, but it has become necessary to cease supporting or actively block some browser versions.

Cookies
Localjobsgroup requires jobseekers to enable session cookies (enabling permanent cookies is recommended), and JavaScript, in their browser.

Terms and conditions of business for recruiters

General
In these terms and conditions:

1. 'Client' means any person, company, organisation or firm which purchases Services from us;

2. Service Agreement' means an order for Services on a form provided by us (in any format) and signed by a Client;

3. 'Services' means all recruitment products and services made available by us from time to time;

4. 'Contract Month' means, in respect of any Service Agreement relating to the provision of Services for a specified period of months, the calendar month commencing on the start date specified in the Service Agreement and ending on the day before the same date in the next calendar month. For example, the calendar month commencing on 24 February and ending 23 March;

5. 'Contract Term' means the full term specified in the Service Agreement.

Commencement of Advertising Services
We will not commence the provision of advertising services until the Service Agreement has been returned to us, in a form approved by us and signed by the Client.

Prices
Prices are for the period stated on the Service agreement or for individual adverts prices are displayed on the Business advertising "Register a Vacancy" page. Localjobsgroup reserves the right to increase prices at any time following an internal price review. Prices are confidential and may not be disclosed by the Client.

If any Services to be used within any time period specified on the Service Agreement are not used within that period of time they may not be carried over into any subsequent period without our prior written consent. The Client will be responsible for payment for any unused Services.

Payments
All prices exclude VAT. All invoices are payable within 14 days. Late payment will entitle localjobsgroup to suspend provision of Services and delete all advertised vacancies and associated products.

Termination
The Client may terminate the provision of Services by no less than 1 months notice.

Localjobsgroup may terminate the provision of Services if:

1. the Client is in material breach of these terms and conditions and has not remedied such breach within 7 days of notice specifying the breach and requiring that it be remedied, or: 2. the Client becomes insolvent, ceases to trade or goes into liquidation.

Limitation of liability
Our liability, and the liability of our third party suppliers, for any loss or damage suffered by you as the result of your use of this site is limited to your actual direct damages or £500, whichever is the less. Except in the case of fraud, excludes any loss of future earnings, profit or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury caused by our negligence.

Job posting

Employment agencies and employment businesses
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that advertisements you place on localjobsgroup comply with your obligations under the Act and Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the advertisements you place on localjobsgroup

Site rules
We have rules regarding the content and format of jobs posted on localjobsgroup. Their purpose is to ensure that users who search the site or the localjobsgroup database get results which are presented as clearly and informatively as possible. You agree that we may, at our discretion and without liability to you, remove from localjobsgroup any advertisement which is posted in breach of these rules. The rules may change from time to time and you are advised to refer to them regularly.

The Rules are:

1. No duplicating of jobs at the expense of other clients' jobs.

2. No gratuitous use of keywords in job descriptions or job titles. Gratuitous means deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing position in the results listing, or increasing the number of page views.

3. Job advertisements placed on localjobsgroup must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'.

4. URLs or email links (live or text only) are not permitted in the body copy of the job description page. Email links are permitted from the 'apply online' link.

Illegal Advertisements
Advertisements which appear to discriminate on grounds of sex, race, age or disability are illegal. If we believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from localjobsgroup without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise.

Responses to advertisements
You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring localjobsgroup into disrepute. You will indemnify us from and against any claim brought by an individual against localjobsgroup arising from your breach of this obligation or any other of these terms and conditions. We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and personal characteristics.

Content and links
If your advertisement links to another site , you are responsible for maintaining the links and for the content of your advertisement and the linked site. We may remove from localjobsgroup any advertisement which contains content or links to a site which, in our opinion, is defamatory, illegal or objectionable or will bring localjobsgroup into disrepute. You will indemnify us from and against any claims or liability arising from content or links contained in your advertisements.

Third party sites
Vacancies you post on localjobsgroup may also appear on third party recruitment web sites pursuant to agreements from time to time between localjobsgroup and the proprietors of such web sites.

Use of candidate database

Employment agencies and employment businesses
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that the use you make of information from our candidate database complies with your obligations under the Act and the various regulations made under it, together with any applicable guidelines. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the use you make of information on our candidate database.

Rights in the database
Database rights and all other applicable copyright and intellectual property rights in the candidate database belong to localjobsgroup. You acknowledge that you do not acquire any rights in the database or its content and that your retention and use of the database and its content is governed by these terms and conditions.

CV search database
Should the client purchase the "CV search database" the client may:

i. Use, search or download Cvs to your database using the Candidate Search link for the purpose of finding suitable candidates for specific job vacancies that you or (if you are an employment agency or employment business) your client wish to fill.

ii. Use the information about the individuals contained in the CVs and database for the purpose of contacting them (either directly or through localjobsgroup ) in relation to a specific job vacancy.

iii. Use the information only in connection with your own recruitment-related activities.

You may NOT:

i. Supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of your group of companies.

ii. Download the database through any automated (e.g. "scraping") process.

iii. Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidates for specific job vacancies. You must, at all times, comply with the Data Protection Act 1998 and all subsequent legislation and regulations.

Deletion of database material
You agree to delete all material from the candidate database upon its replacement with up-to-date material or the satisfactory conclusion of your search for a suitable candidate, whichever occurs first.

Dealings with candidates
You agree to deal fairly and professionally with individuals you may contact using information from the candidate database and not do anything which may bring localjobsgroup into disrepute. You will indemnify localjobsgroup from and against any claim brought by an individual against localjobsgroup arising from your breach of this obligation or any other of these terms and conditions.

Passwords
Passwords are for the sole use of the person to whom they are issued. We may deny access to a password if we reasonably believe that it is being used by an unauthorised person or that the user is breaching these terms and conditions.

Other
If there is any conflict between these terms and specific terms appearing elsewhere on this Website then the latter shall prevail. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable. These terms and conditions are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts, without giving effect to any principles of conflicts of law.
